TERMS OF SERVICE

SECTION 1 — OVERVIEW AND ACCEPTANCE OF TERMS

This website is operated by Bella Luna Gowns LLC (“Bella Luna Gowns,” “we,” “us,” or “our”).

Bella Luna Gowns provides this website, including information, products, tools, custom-design services, made-to-measure services, and other services available through the website (collectively, the “Services”), subject to these Terms of Service (“Terms”).

By accessing our website, submitting an inquiry, placing an order, making a purchase, approving a custom design, submitting measurements, or otherwise using our Services, you agree to be bound by these Terms and by all policies incorporated into them by reference, including our Privacy Policy, Refund Policy, Shipping Policy, Custom Order Policy, and any written specifications applicable to your individual order.

If you do not agree to these Terms, you should not access or use the Services or place an order with Bella Luna Gowns.

Our store is hosted by Shopify Inc., which provides the ecommerce platform through which our products and Services are offered.

SECTION 2 — ELIGIBILITY AND ONLINE STORE TERMS

By using our Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.

You may not use our products, Site, or Services for any illegal or unauthorized purpose.

You may not transmit viruses, malware, malicious code, or other material intended to disrupt or interfere with the Services.

We reserve the right to refuse or discontinue Service where reasonably necessary, including in cases involving suspected fraud, abuse, payment disputes, unlawful activity, intellectual-property concerns, threats, harassment, or violations of these Terms.

SECTION 3 — ONLINE-ONLY BUSINESS MODEL

Bella Luna Gowns is primarily an online custom bridal and formalwear business.

Unless expressly agreed otherwise in writing, our custom and made-to-measure services are provided remotely and do not include in-person fittings, showroom appointments, or alterations performed by Bella Luna Gowns.

Customers are responsible for reviewing all product descriptions, custom-order specifications, measurements, policies, and communications before approving or placing an order.

SECTION 4 — PRODUCT IMAGES, COLORS AND VISUAL REPRESENTATIONS

We make reasonable efforts to display our products accurately.

However, colors, sheen, sparkle, transparency, lace, embroidery, beadwork, texture, fabric movement, and other details may appear differently because of:

  • lighting;
  • photography;
  • camera settings;
  • screen or monitor settings;
  • device displays;
  • fabric dye lots;
  • handmade construction;
  • material availability; and
  • normal production variation.

Some website images may include styled photography, digital editing, AI-assisted model imagery, or other visualization techniques.

AI-assisted or conceptual imagery is intended to help illustrate a design and does not guarantee that every visual characteristic shown by artificial intelligence can be physically reproduced exactly in a real garment.

Actual gown photographs, approved materials, written specifications, customer-approved measurements, and the final Custom Order Review take precedence over conceptual, AI-generated, inspirational, or illustrative imagery.

SECTION 5 — HANDCRAFTED GARMENTS AND NATURAL VARIATION

Many Bella Luna Gowns products contain handcrafted, hand-applied, embroidered, embellished, beaded, lace, corseted, or couture construction.

Reasonable variations may occur in:

  • lace placement;
  • appliqué placement;
  • embroidery;
  • bead placement;
  • handwork;
  • fabric texture;
  • dye lots;
  • decorative elements;
  • embellishment density;
  • stitching;
  • symmetry of handmade details; and
  • other characteristics inherent to handcrafted garments.

Reasonable handmade variation does not constitute a manufacturing defect.

SECTION 6 — CUSTOM, MADE-TO-MEASURE AND SPECIAL-ORDER SALES ARE FINAL

ALL CUSTOM, PERSONALIZED, MADE-TO-MEASURE, MADE-TO-ORDER, MODIFIED, ALTERED, AND SPECIAL-ORDER GARMENTS ARE FINAL SALE UPON PURCHASE AND ARE NOT ELIGIBLE FOR CANCELLATION, RETURN, EXCHANGE, REFUND, OR STORE CREDIT, EXCEPT TO THE EXTENT A REMEDY IS EXPRESSLY REQUIRED BY APPLICABLE LAW.

Because these garments are created, sourced, modified, or manufactured specifically for the individual customer and generally cannot be resold in the ordinary course of business, the customer's purchase constitutes a final and binding commitment to the order.

For purposes of these Terms, production begins when Bella Luna Gowns or its production partners begin any material step specifically for the customer's order, including material procurement, fabric or lace sourcing, pattern development, cutting, embroidery, beadwork, embellishment, sewing, construction, or other order-specific production activity.

Final-sale status applies even if the customer later:

  • changes their mind;
  • changes or cancels their wedding or event;
  • postpones their event;
  • purchases another gown;
  • no longer needs the garment;
  • changes size or weight;
  • experiences pregnancy or other body changes;
  • prefers a different style;
  • dislikes a previously approved design choice;
  • decides they prefer a different fabric, lace, color, neckline, sleeve, silhouette, train, embellishment, or other detail;
  • requires alterations;
  • provides inaccurate measurements;
  • fails to follow measurement instructions;
  • changes shoes or undergarments;
  • expects a different fit preference;
  • changes their aesthetic preference after approval; or
  • encounters another circumstance unrelated to a material manufacturing error by Bella Luna Gowns.

The need for alterations does not make a custom or made-to-measure garment refundable.

Nothing in these Terms eliminates a right or remedy that applicable law does not permit the parties to waive.

SECTION 7 — CUSTOMER-SUPPLIED MEASUREMENTS — CUSTOMER ASSUMES RESPONSIBILITY

THE CUSTOMER IS SOLELY RESPONSIBLE FOR THE ACCURACY OF ALL MEASUREMENTS PROVIDED TO BELLA LUNA GOWNS.

Bella Luna Gowns manufactures made-to-measure garments using measurements supplied and approved by the customer.

Because Bella Luna Gowns does not physically measure customers through an in-person fitting, we cannot independently verify whether customer-supplied measurements are accurate.

By submitting or approving measurements, the customer represents and confirms that:

  • the measurements were taken accurately;
  • Bella Luna Gowns' measurement instructions were followed;
  • the measurements were not estimated;
  • extra ease was not intentionally added or deducted unless instructed by Bella Luna Gowns;
  • the measurements belong to the individual who will wear the garment;
  • the customer reviewed the measurements before approving them; and
  • the customer understands Bella Luna Gowns will rely upon those measurements when producing the garment.

CUSTOMER MEASUREMENT ERROR IS NOT A MANUFACTURING DEFECT.

Bella Luna Gowns is not responsible for fit problems resulting from:

  • inaccurate measurements;
  • incorrectly taken measurements;
  • estimated measurements;
  • transposed numbers;
  • incomplete measurements;
  • altered measurements;
  • customer-added or customer-deducted ease;
  • failure to follow instructions;
  • weight gain or loss;
  • pregnancy;
  • surgery;
  • body-composition changes;
  • posture;
  • footwear;
  • undergarments;
  • shapewear;
  • personal fit preference; or
  • physical changes occurring after measurements are submitted.

A garment produced consistently with the measurements supplied and approved by the customer will not be considered defective merely because it does not fit the customer as expected.

If Bella Luna Gowns identifies a measurement that appears unusual and asks the customer to confirm or remeasure it, the customer remains responsible for the measurement ultimately confirmed and approved.

SECTION 8 — MADE-TO-MEASURE DOES NOT GUARANTEE AN ALTERATION-FREE FIT

“Made-to-measure” means that the garment is constructed using the measurements supplied by the customer.

It does not mean that Bella Luna Gowns conducts an in-person bespoke fitting process, and it does not guarantee that the finished garment will require no alterations.

Bridal and formal garments are highly structured garments. Local tailoring may be necessary to achieve the customer's preferred:

  • bust fit;
  • waist placement;
  • hem length;
  • sleeve fit;
  • strap tension;
  • neckline position;
  • bodice fit;
  • train handling;
  • corset tension; or
  • overall personal fit preference.

Unless Bella Luna Gowns expressly agrees otherwise in writing, all alteration costs are the customer's responsibility.

The need for ordinary tailoring or alterations is not grounds for cancellation, return, exchange, chargeback, store credit, or refund.

SECTION 9 — INSPIRATION IMAGES, SKETCHES AND AI-GENERATED REFERENCES

Customers may submit photographs, screenshots, sketches, existing gowns, AI-generated images, social-media images, or other visual materials as design inspiration.

Such materials communicate aesthetic preferences and design concepts.

Unless Bella Luna Gowns expressly agrees otherwise in writing, an inspiration image is not a promise to create an exact replica.

AI-generated imagery may depict:

  • nonexistent fabrics;
  • unrealistic draping;
  • impossible garment construction;
  • unrealistic proportions;
  • embellishment patterns that do not physically exist;
  • impossible transparency or movement; or
  • other characteristics that cannot be exactly recreated in a physical garment.

Bella Luna Gowns will interpret inspiration into a physically achievable garment using appropriate materials and construction methods.

Bella Luna Gowns may refuse to reproduce a design if we believe doing so would infringe another party's intellectual-property rights or cannot reasonably be constructed as shown.

SECTION 10 — FINAL CUSTOM ORDER REVIEW CONTROLS THE ORDER

For custom orders, Bella Luna Gowns may prepare a Custom Order Review, order summary, specification sheet, measurement record, written approval request, photographs, or other documentation identifying the customer's final design and order details.

The customer is responsible for carefully reviewing all information before approval.

The customer must notify Bella Luna Gowns of any error before approving production.

Once the customer approves the final Custom Order Review or other final written specifications, those approved specifications become the controlling description of the order.

If earlier messages, inspiration photographs, social-media conversations, verbal discussions, screenshots, sketches, or other preliminary communications conflict with the final approved Custom Order Review, the final approved Custom Order Review controls.

Any requested feature that does not appear in the final approved specifications should not be assumed to be included.

Approval authorizes Bella Luna Gowns to proceed with production.

SECTION 11 — MATERIALS AND DESIGN FEASIBILITY

Bella Luna Gowns selects and sources materials appropriate for the design and quality level of the garment.

Fabric, lace, beadwork, embellishment, trims, structure, and construction techniques may differ from inspiration imagery because of:

  • material availability;
  • physical feasibility;
  • durability;
  • construction requirements;
  • design compatibility;
  • production limitations; and
  • other legitimate manufacturing considerations.

Where customer approval of a material option is requested, the customer is responsible for reviewing and approving that option before production proceeds.

Bella Luna Gowns is not required to compromise material quality or craftsmanship in order to meet a customer's requested budget.

SECTION 12 — CHANGES AFTER DESIGN APPROVAL

Customer-requested changes after final design approval may not be possible.

If Bella Luna Gowns agrees to a change after approval, the change may require:

  • additional materials;
  • additional labor;
  • additional production time;
  • additional shipping; or
  • additional charges.

Bella Luna Gowns is not obligated to accept changes after production begins.

A customer-requested design change does not restart or cancel the original production commitment unless Bella Luna Gowns expressly agrees otherwise in writing.

SECTION 13 — PRODUCTION TIMES AND EVENT DATES

Production times are estimates unless Bella Luna Gowns expressly provides a written guaranteed completion date.

Custom and made-to-measure production may take up to approximately 16 weeks, depending on the design, complexity, materials, customization, beadwork, embroidery, handwork, production conditions, and other circumstances.

We recommend ordering approximately five to six months before the wedding or event to provide time for production, shipping, and local alterations.

The customer is responsible for ordering sufficiently early.

Providing Bella Luna Gowns with a wedding date or event date does not by itself create a guaranteed delivery date.

Bella Luna Gowns is not responsible for losses associated with an event date where the customer ordered without sufficient lead time or where delay results from matters outside Bella Luna Gowns' reasonable control.

SECTION 14 — FINAL PHOTOS AND APPROVAL BEFORE SHIPPING

For qualifying new custom or bespoke designs, Bella Luna Gowns may provide final photographs of the completed garment before shipment.

Final photographs allow the customer to review the visible design and workmanship.

Final-photo review is not an in-person fitting.

Final-photo approval does not guarantee that the customer will require no local tailoring.

Photographs may differ slightly from the garment's appearance in person because of lighting, cameras, screens, color settings, and other visual factors.

If a customer identifies a visible concern in final photographs, the customer should notify Bella Luna Gowns before approving shipment.

SECTION 15 — CLAIMED MANUFACTURING ERROR OR NONCONFORMITY

If a customer believes a garment contains a material manufacturing error or materially differs from the final approved written specifications, the customer must promptly notify Bella Luna Gowns and provide reasonable documentation necessary to evaluate the issue.

Documentation may include:

  • photographs;
  • videos;
  • measurements of the garment;
  • photographs showing fit;
  • copies of approved measurements;
  • photographs of packaging;
  • or other reasonable evidence.

The existence of a complaint or dispute does not automatically entitle the customer to a refund.

To the maximum extent permitted by applicable law, Bella Luna Gowns will have the first reasonable opportunity to inspect the alleged issue and determine whether corrective action is appropriate.

Where an actual manufacturing issue can reasonably be corrected, Bella Luna Gowns may elect to:

  • repair the garment;
  • correct the affected area;
  • modify the garment;
  • replace an affected component;
  • replace the garment; or
  • remake the garment.

A customer should not materially alter, cut, modify, repair, or permit a third party to alter the disputed portion of a garment before giving Bella Luna Gowns a reasonable opportunity to evaluate the claim.

If third-party alterations materially prevent Bella Luna Gowns from determining the original condition or cause of a claimed issue, this may affect the remedies available to the customer to the extent permitted by law.

A customer's refusal to permit reasonable inspection or corrective performance does not automatically convert a final-sale custom order into a refundable order.

Nothing in this section limits remedies that applicable law does not permit the parties to waive.

SECTION 16 — INSPECTION UPON DELIVERY

Customers should inspect their order promptly after delivery.

Visible shipping damage, missing items, or apparent manufacturing concerns should be reported to Bella Luna Gowns as soon as reasonably possible so that we can investigate and, where appropriate, preserve carrier or supplier claims.

Customers claiming shipping damage should retain the original packaging until instructed otherwise.

SECTION 17 — PRICES AND PAYMENT

Prices are displayed as stated on the Site and may change without notice before purchase.

Once an order is accepted, the price for that order will generally remain the agreed amount unless:

  • the customer requests additional customization;
  • additional materials or work are requested;
  • the scope of the order changes; or
  • another agreed adjustment becomes necessary.

Custom-gown pricing depends on factors including:

  • materials;
  • lace;
  • embellishment;
  • beadwork;
  • labor;
  • construction;
  • design complexity;
  • customization; and
  • other production requirements.

Applicable taxes will be collected where required.

For international orders accepted by Bella Luna Gowns, customers are responsible for customs duties, import taxes, brokerage fees, and governmental charges unless expressly stated otherwise.

SECTION 18 — ORDER ACCEPTANCE AND CANCELLATION BY BELLA LUNA GOWNS

Bella Luna Gowns reserves the right to refuse or cancel an order when reasonably necessary, including because of:

  • suspected fraud;
  • payment problems;
  • pricing errors;
  • listing errors;
  • material unavailability;
  • inability to manufacture a requested design;
  • intellectual-property concerns;
  • abusive conduct;
  • threats or harassment;
  • unlawful activity; or
  • circumstances that make fulfillment impracticable.

If Bella Luna Gowns cancels an order before production for reasons unrelated to a customer's breach, amounts paid for the cancelled portion will be handled according to applicable law and our policies.

SECTION 19 — SHIPPING AND DELIVERY

Shipping estimates are separate from production estimates.

Bella Luna Gowns generally uses tracked and insured shipping where stated.

After an order is transferred to a carrier, transit may be affected by circumstances outside Bella Luna Gowns' control, including:

  • weather;
  • transportation disruptions;
  • customs;
  • carrier delays;
  • incorrect addresses;
  • regional service interruptions; or
  • other delivery problems.

Customers are responsible for providing a complete and accurate shipping address.

If a shipment is delayed, returned, rerouted, or undeliverable because of an incorrect customer-provided address or the customer's failure to accept delivery, additional costs may apply.

Bella Luna Gowns will reasonably cooperate with carrier claims where appropriate but does not control carrier transit schedules.

SECTION 20 — CHARGEBACKS AND PAYMENT DISPUTES

If you believe there is a problem with an order or payment, we encourage you to contact Bella Luna Gowns promptly so that we may investigate and attempt to resolve the issue.

Nothing in these Terms waives any lawful right you have through your payment provider.

If a chargeback, payment dispute, or financial claim is initiated, Bella Luna Gowns may provide the payment processor, card network, bank, court, arbitrator, insurer, or other appropriate entity with documentation relating to the transaction, including:

  • order records;
  • checkout acceptance records;
  • Terms and policies applicable at the time of purchase;
  • measurements;
  • customer measurement approvals;
  • Custom Order Reviews;
  • design approvals;
  • material approvals;
  • photographs;
  • videos;
  • customer communications;
  • final-photo approvals;
  • tracking records;
  • carrier documentation;
  • delivery confirmation; and
  • other evidence reasonably relevant to the dispute.

Bella Luna Gowns reserves the right to refuse future orders from customers who initiate fraudulent or knowingly false disputes.

SECTION 21 — CUSTOMER-SUPPLIED CONTENT AND INTELLECTUAL PROPERTY

When you provide photographs, designs, screenshots, sketches, images, text, or other materials to Bella Luna Gowns, you represent that you are legally permitted to provide those materials for purposes of your order.

Bella Luna Gowns may use customer-supplied materials internally and share them with production partners as reasonably necessary to develop and manufacture the customer's order.

Submission of inspiration imagery does not transfer ownership of that imagery to Bella Luna Gowns.

Bella Luna Gowns may refuse to reproduce materials that we reasonably believe infringe the intellectual-property rights of others.

SECTION 22 — CUSTOMER REVIEWS, PHOTOGRAPHS AND MARKETING CONTENT

If you voluntarily provide Bella Luna Gowns with a review, testimonial, photograph, video, social-media post, or other content specifically for publication, promotion, reposting, or marketing, you grant Bella Luna Gowns a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, repost, adapt, and use that content for Bella Luna Gowns' website, portfolio, social media, advertising, and marketing.

This license does not automatically apply to private photographs or videos supplied solely for measurement, customer service, order processing, fit evaluation, or other private communications.

If a photographer or other creator owns rights in material you provide for publication, you are responsible for obtaining appropriate permission to authorize its use.

SECTION 23 — BELLA LUNA GOWNS INTELLECTUAL PROPERTY

Unless otherwise stated, Bella Luna Gowns owns or licenses the Site's proprietary content, including:

  • branding;
  • logos;
  • text;
  • original photography;
  • graphics;
  • product descriptions;
  • page designs;
  • original design materials; and
  • other proprietary Site content.

You may not reproduce, copy, scrape, sell, distribute, commercially exploit, or create unauthorized derivative works from Bella Luna Gowns' proprietary content without written permission.

SECTION 24 — THIRD-PARTY TOOLS AND SERVICES

Our Services may integrate with third-party services including ecommerce, payment, analytics, marketing, messaging, shipping, accounting, fraud-prevention, review, accessibility, and technology providers.

We are not responsible for third-party systems or services outside our reasonable control.

Your use of third-party services may also be governed by those providers' own terms and privacy policies.

SECTION 25 — THIRD-PARTY LINKS

Our Site may contain links to websites or services operated by third parties.

Bella Luna Gowns does not control and is not responsible for third-party websites, products, services, policies, content, availability, or security.

SECTION 26 — PRIVACY

Our collection and processing of personal information are governed by our Privacy Policy:

Our Privacy Policy is incorporated into these Terms by reference.

SECTION 27 — SMS AND TEXT MESSAGING

If you consent to receive SMS or text messages from Bella Luna Gowns, you may receive recurring transactional and/or marketing messages, including:

  • order notifications;
  • transactional messages;
  • abandoned-checkout reminders;
  • promotional offers;
  • marketing messages; and
  • requests for reviews.

Consent to marketing messages is not a condition of purchase.

Message frequency may vary. Message and data rates may apply.

You may opt out of marketing text messages by replying STOP where supported.

For assistance, reply HELP or contact us.

Wireless carriers are not responsible for delayed or undelivered messages.

To the maximum extent permitted by law, Bella Luna Gowns is not responsible for failed, delayed, or misdirected message delivery caused by mobile carriers, telecommunications providers, technical outages, or circumstances outside our reasonable control.

SECTION 28 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Site may occasionally contain typographical errors, inaccuracies, omissions, or outdated information relating to:

  • descriptions;
  • pricing;
  • promotions;
  • availability;
  • shipping;
  • production estimates; or
  • other matters.

We reserve the right to correct errors and update information.

If a material pricing or listing error affects an order, Bella Luna Gowns may contact the customer to correct the order or cancel and refund the affected portion as appropriate.

SECTION 29 — PROHIBITED USES

You may not use the Site or Services to:

  • violate applicable law;
  • commit fraud;
  • infringe intellectual-property rights;
  • distribute malware;
  • collect unauthorized personal information;
  • scrape or harvest Site content without authorization;
  • interfere with Site security;
  • impersonate another person;
  • submit materially false information;
  • harass, threaten, or abuse others; or
  • otherwise misuse the Services.

We may suspend or terminate access for violations of these Terms.

SECTION 30 — DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED BY BELLA LUNA GOWNS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, COMPLETELY SECURE, OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES A WARRANTY, RIGHT, OR REMEDY THAT APPLICABLE LAW DOES NOT PERMIT TO BE EXCLUDED.

SECTION 31 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLA LUNA GOWNS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE SITE, SERVICES, OR PRODUCTS.

This includes, where permitted by law:

  • loss of profits;
  • loss of revenue;
  • replacement expenses;
  • wedding or event expenses;
  • travel expenses;
  • photography expenses;
  • venue costs;
  • emotional distress damages;
  • consequential event-related losses; or
  • other indirect losses.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLA LUNA GOWNS' TOTAL AGGREGATE LIABILITY ARISING FROM A PARTICULAR ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO BELLA LUNA GOWNS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot lawfully be excluded or limited.

SECTION 32 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bella Luna Gowns LLC and its owners, employees, contractors, agents, affiliates, and service providers from third-party claims, damages, liabilities, and reasonable legal expenses arising from:

  • your unlawful use of the Services;
  • your breach of these Terms;
  • materials you provide in violation of another person's rights;
  • infringement caused by customer-supplied content; or
  • your violation of applicable law.

SECTION 33 — FORCE MAJEURE

Bella Luna Gowns will not be liable for delay or failure to perform caused by circumstances beyond our reasonable control, including:

  • natural disasters;
  • fire;
  • flood;
  • severe weather;
  • earthquakes;
  • epidemic or pandemic conditions;
  • war;
  • terrorism;
  • civil disturbance;
  • government action;
  • labor disputes;
  • power outages;
  • internet outages;
  • supplier failures;
  • material shortages;
  • customs delays;
  • carrier disruptions;
  • transportation failures; or
  • other events beyond our reasonable control.

When such circumstances occur, Bella Luna Gowns will make reasonable efforts to resume performance when reasonably possible.

SECTION 34 — TERMINATION

These Terms remain effective unless terminated.

Bella Luna Gowns may suspend or terminate access to the Services where a user violates these Terms or continued Service presents fraud, security, payment, legal, or operational concerns.

Rights and obligations arising before termination survive where appropriate.

SECTION 35 — INFORMAL DISPUTE RESOLUTION

Before initiating arbitration or litigation, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.

A party asserting a dispute should provide written notice describing:

  • the order involved;
  • the nature of the dispute;
  • the relief requested; and
  • information reasonably necessary to evaluate the claim.

Nothing in this section prevents either party from bringing an eligible claim in small claims court or seeking emergency relief where permitted by law.

SECTION 36 — BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes eligible for small claims court and claims that applicable law does not permit to be arbitrated, you and Bella Luna Gowns agree that disputes arising from or relating to:

  • these Terms;
  • the Site;
  • the Services;
  • an order;
  • a custom garment;
  • a payment;
  • or your relationship with Bella Luna Gowns

will be resolved through binding individual arbitration rather than through a jury trial.

The arbitration will be governed by the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under the applicable consumer arbitration rules.

Arbitration may occur remotely, through written submissions, or in Ventura County, California, as permitted by applicable rules and law.

The arbitrator may award individualized relief available under applicable law.

Arbitration Opt-Out

You may opt out of this arbitration provision by sending written notice within 30 days after your first purchase made after these Terms become applicable to you.

The notice must include:

  • your full name;
  • mailing address;
  • order number, if available; and
  • a clear statement that you wish to opt out of the arbitration agreement.

Opting out of arbitration will not affect your order or your relationship with Bella Luna Gowns.

SECTION 37 — CLASS ACTION WAIVER

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BELLA LUNA GOWNS AGREE THAT CLAIMS SUBJECT TO ARBITRATION WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY.

Neither party may bring or participate in a class, collective, consolidated, or representative arbitration except where applicable law requires otherwise.

Questions regarding the enforceability of this Class Action Waiver will be determined as required by applicable law.

SECTION 38 — GOVERNING LAW

Except where superseded by applicable federal law, these Terms and the relationship between the customer and Bella Luna Gowns are governed by the laws of the State of California, without regard to conflict-of-law principles.

The Federal Arbitration Act governs the arbitration agreement above.

For disputes not subject to arbitration or eligible small claims proceedings, venue will be determined according to applicable law.

SECTION 39 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 40 — NO WAIVER

Bella Luna Gowns' failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

SECTION 41 — ENTIRE AGREEMENT AND ORDER OF PRECEDENCE

These Terms, together with all policies incorporated by reference and any written specifications applicable to an individual order, constitute the agreement between the customer and Bella Luna Gowns regarding the Services.

For custom orders, if there is a conflict concerning the approved garment design, the following order of precedence applies:

  1. final written Custom Order Review or final written order specifications approved by the customer;
  2. approved measurements and material selections;
  3. product listing or custom listing applicable to the order;
  4. these Terms and incorporated policies;
  5. earlier communications and inspiration materials.

Preliminary messages, inspiration imagery, verbal discussions, or earlier drafts do not override final written specifications approved by the customer.

SECTION 42 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our Services, business practices, technology, or legal requirements.

The current version will be posted on this page with an updated revision date.

Changes apply prospectively except where otherwise permitted or required by law.
